30 years experience in the rotorcraft industry

Over the last 27 years ARWA members have handled all types of transactional work across the helicopter industry and acted in all kinds of disputes on behalf of industry players. ARWA members are familiar with the issues that arise in all types of helicopter applications including emergency medical services, corporate services, search and rescue operation, oil & gas, defence, and homeland security.

Our experts have worked across the world from the North Sea, to the Persian Gulf, from the Black Sea to West Africa, East Asia and Brazil. We have advised civil aviation authorities, OEMs, helicopter operators, aircraft lessors, helicopter maintenance providers, sovereigns, and have negotiated and settled disputes arising in connection with a wide range of industry-specific contracts (wet, dry, or damp leases, PBH/SBH contracts, etc), regulations (Part-145 or CAMO regulations), guidelines (IOGP AMG), or client requirements.

Lawyers trained in continental law and common law

ARWA members are trained in Portuguese law, Brazilian law, French law, the United States, combining deep experience in both common and civil law. Our team has handled disputes across five continents. We advise and represent clients in English, Portuguese, Spanish, and French.

Experts in international arbitration and cross-border disputes

ARWA members are international arbitration specialists. They have acted under the rules of leading arbitration institutions such as the ICC, the LCIA, ICSID, or the CAC-CCIP, as well as in ad hoc arbitrations. Prior to joining ARWA they practiced arbitration in leading law firms in Paris, London, Washington DC, Lisbon, and Buenos Aires. They have conducted arbitration proceedings in English, Portuguese, Spanish, and French.

OUR EXPERIENCE

Transactional work

Advising major players of the financing market of the aviation sector, including lessors and lessees

Advising either aircraft manufacturers or operators in the sale/purchase of new aircrafts

Advising companies in drafting wet leases, dry leases and ACMI leases

Advising aircraft operators in all aspects of fleet management as well as power and service by the hour contracts with manufacturers

Advising aircraft operators and maintenance providers on maintenance arrangements (including Part-145 EASA), CAMO management contracts and ICAO licensing

Advising civil aviation authorities on drafting international agreements under Article 83 bis of the Chicago Convention

Dispute resolution

Representing a helicopter operator in an ICC arbitration arising out of a service agreement for the provision of offshore helicopter services

Representing helicopter operators in negotiations in the context of Chapter 11-type procedures in Europe (Portugal, UK, France) and the United States

Representing a private helicopter operator against a European state in ad hoc arbitration proceedings relating to a helicopter dry lease

Cross-examining aviation experts in international arbitration proceedings

Representing clients in disputes arising out of all types of helicopter missions (including logging, aerial inspection of powerlines, EMS, firefighting, offshore transportation), health and safety issues (including simple incidents or fatalities), and even disputes arising out of innovations or of the implementation of airworthiness directives and service bulletins

Nuno has over 27 years of experience as a lawyer, all of which have been spent specialising in aeronautical law. He has in-depth knowledge of the rotorcraft industry, in particular of non-scheduled air transport and aerial work. Nuno has also been involved in various domestic international arbitration proceedings, in the context of which his knowledge of the sector and its players has proved to be crucial. In addition to being a member of Associated Rotary Wing Advisors, Nuno is the majority partner of a Lisbon-based law firm, where he also routinely practices Administrative Law, Tax Law and Criminal Law, whilst also providing consultancy and business services to companies in different sectors.

Pacôme has over a decade of experience in arbitration and dispute avoidance and resolution.
